By accessing our website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Use of the website

You may use our website for lawful purposes only. You agree not to:

• Use the website in any way that violates applicable local, national, or international laws or regulations.
• Transmit unsolicited commercial communications (spam).
• Attempt to gain unauthorised access to any part of the website or its related systems.
• Introduce viruses, trojans, worms, or other malicious code.
• Scrape, crawl, or harvest data from our website without our prior written consent.
• Reproduce, duplicate, or copy any content from our website for commercial purposes without authorisation.

Services & client engagements

All service engagements — including app development projects, advertising campaign management, and social media growth packages — are governed by a separate written agreement or proposal confirmed between 3W Studio and the client. These Terms apply in addition to any such agreements.

We reserve the right to refuse, modify, or terminate services at our discretion if a client violates these Terms, engages in fraudulent activity, or acts in a manner harmful to our team or reputation.

Intellectual property

All content on this website — including text, graphics, logos, code, and design — is the property of 3W Studio or its licensors and is protected by applicable intellectual property laws.

Upon full payment, clients receive ownership of custom deliverables (e.g. developed applications, creative assets) as specified in the signed project agreement. We retain the right to display work in our portfolio unless otherwise agreed in writing.

You may not reproduce, distribute, or create derivative works from our website content without prior written permission.

Advertising & campaign management

When engaging 3W Studio for Google Ads, Meta Ads, Amazon PPC, or any paid advertising service, the client acknowledges that:

• Advertising results are not guaranteed. Performance depends on market conditions, budgets, competition, and other factors outside our direct control.
• Clients are responsible for ensuring that all products, services, and content to be advertised comply with the policies of the relevant advertising platforms.
• Ad spend is billed directly to the client's platform account or invoiced separately; management fees do not include ad spend unless explicitly stated.
• We act as an authorised manager of client ad accounts and do not assume ownership of those accounts.

Payment & fees

Payment terms for all services are specified in the project proposal or service agreement. Unless otherwise agreed:

• Invoices are due within 14 days of issue.
• Late payments may incur a monthly interest charge of 1.5% or the maximum permitted by law.
• We reserve the right to pause or suspend services in the event of non-payment.
• Refund eligibility is determined on a case-by-case basis and is outlined in the individual service agreement.

Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared in the course of an engagement, including business strategies, client data, technical documentation, and campaign performance data. This obligation survives the termination of any service agreement.

Limitation of liability

To the fullest extent permitted by law, 3W Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including but not limited to loss of revenue, loss of data, or loss of business opportunity.

Our total liability for any claim arising from our services shall not exceed the total fees paid by the client to 3W Studio in the three months preceding the claim.

Disclaimer of warranties

Our website and services are provided "as is" without warranties of any kind, whether express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses. We make no guarantees regarding specific results from our advertising or marketing services.

Third-party links & platforms

Our website may contain links to third-party websites or integrate with platforms such as Google, Meta, and Amazon. These are provided for convenience only. We are not responsible for the content, privacy practices, or terms of any third-party platform, and a link does not constitute an endorsement.

Termination

We reserve the right to terminate or suspend access to our website and services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the public.

Upon termination of a service engagement, each party shall return or destroy confidential materials belonging to the other, and all outstanding invoices become immediately due and payable.

Governing law

These Terms shall be governed by and construed in accordance with applicable international commercial laws. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.

Changes to these terms

We may revise these Terms at any time. Changes will be effective immediately upon posting to this page with an updated "Last updated" date. Continued use of our website or services following any changes constitutes your acceptance of the revised Terms.
